TERMS AND CONDITIONS

Simple Credit is subject to federal and provincial privacy laws, including the Personal Information Protection and Electronic Documents Act (S.C. 2000, c. 5) and the Act Respecting the Protection of Personal Information in the Private Sector (R.S.Q., c. P-39.1). Therefore, Simple Credit is required to take the necessary measures to comply with these laws and ensure the confidentiality and protection of its clients’ personal information collected, in particular, in connection with service requests or endorsement applications.

This Privacy Policy sets forth Simple Credit practices regarding the collection, use and disclosure of its clients’ personal information. It also constitutes Simple Credit governance policy with respect to personal information. 

 

Personal information

Personal information is understood to mean any information relating to a natural person that directly or indirectly identifies them. 

 

Information collection methods

Simple Credit collects various personal information for the purpose of offering services and products tailored to its current and future clientele. This collection takes place during direct and indirect interactions with its clients, in particular, through online applications or interactive forms available on Simple Credit website. 

By completing an interactive form or endorsement application and submitting supporting documents, the client consents to these terms and conditions in favour of Simple Credit. It also consents to Simple Credit obtaining personal information from third parties identified in interactive forms or endorsement applications, such as financial institutions, employers and personal information agencies.

Simple Credit may also collect personal information and financial data from the creditors, if applicable, to validate the accuracy of personal information provided by the client. 

By completing an interactive form or endorsement application and submitting supporting documents, the client consents to Simple Credit collection of personal information from the creditors, if applicable.

In addition to the information submitted by the client, Simple Credit may also collect, through software, information about the client’s computer, including, where applicable, the client’s IP address, operating system and browser type, for system administration purposes and general information transmission to advertisers. 

By completing an interactive form or endorsement application and submitting supporting documents, the client consents to the use of such technologies by Simple Credit.

Simple Credit may also collect statistical data on browsing habits. This information does not allow for the identification of an individual. Simple Credit may also obtain information about the general use of the Internet by the client, using cookie files stored on the hard drive of that client’s computer. 

By completing an interactive form or endorsement application and submitting supporting documents, the client consents to this collection by Simple Credit.

 

Information collected

The information collected includes:

  • Surname, first name, postal address;
  • Telephone and fax numbers;
  • Email address;
  • Date of birth, sex;
  • Family situation;
  • Social insurance, health insurance and driver’s licence numbers;
  • Occupation and employment (duration, salary, etc.);
  • Name and contact information of employer;
  • Income (personal, family and other sources of income);
  • Financial status data (assets, liabilities, bank account statements, etc.);
  • Information about the client’s computer (IP address, operating system, browser type, etc.);
  • Any other information collected with the client’s approval.

 

 

Purposes for which the information is collected

The personal information collected by Simple Credit is confidential and is collected for the primary purpose of assessing the client’s eligibility for the endorsement requested and to respond to said endorsement applications, if applicable. It is also used for the purpose of distributing promotional material via newsletters and/or email.

Personal information collected will only be used for the purposes for which it was collected, except for the exceptions provided for by law. 

Use of personal information

Simple Credit uses personal information in the normal course of its business operations, in particular, to create the client account, communicate with the client in the administration of their account, provide services and answer the client’s questions, establish and verify the client’s identity and the veracity and accuracy of the information provided, verify their credit, endorsement eligibility, employment, references and contacts, and conduct endorsement and collection procedures.

Simple Credit may communicate a nominative list of its clients to one or more third parties for commercial or philanthropic prospecting purposes. A nominative list is a list of names, telephone numbers, and geographical addresses or technological addresses of natural persons where they may receive communication of a document or technological information. If necessary, the client will be informed in advance by Simple Credit of its intention to share the nominative list of its clients with one or more third parties. The client will then have the valid opportunity to accept or refuse the sharing of information about themselves. The client retains the right to withdraw consent at any time to such use of their personal information.

Simple Credit may use the personal information collected to send promotional materials or other information regarding the company’s services and products to its clients. Clients who wish to remove their contact information from the mailing list may contact Simple Credit at the coordinates provided at the bottom of this document or by clicking on the “Unsubscribe” tab at the bottom of one of the mailings.

By consenting to these terms and conditions, the client agrees to be subscribed to the mailing list of promotional materials and newsletters.

 

Access to information

Simple Credit agents authorized to manage client accounts and respond to endorsement applications have access to the personal information contained therein. Simple Credit advertising and promotional agents have access to only the information necessary to create and manage mailing lists for promotional purposes.

Simple Credit may disclose the client’s personal information to loan brokers, financial institutions, creditors and employer(s) in the performance of its obligations under the endorsement agreement with the client.

By completing an interactive form or endorsement application and submitting supporting documents, the client consents to this transmission of personal information to loan brokers, financial institutions, creditors and employer(s) by Simple Credit.

Simple Credit may transmit personal information collected from current or future clients to Technologie Flinks Inc. as part of a bank authentication process. Simple Credit then obtains information on the banking products held by the client or future client from the financial institution used in the bank authentication process. This summary is used to determine the client’s eligibility for the endorsement requested.

By completing an interactive form or endorsement application and submitting supporting documents, the client consents to this transmission of personal information to Technologie Flinks Inc. by Simple Credit.

Simple Credit may disclose the client’s personal information to collection agencies, legal studies and judicial bodies for debt collection purposes as well as for the exercise of any recourse arising from the service contract entered into with the client.

By completing an interactive form or endorsement application and submitting supporting documents, the client consents to this transmission of personal information to collection agencies, legal studies and judicial bodies by Simple Credit.

Simple Credit may be required to disclose the client’s personal information in order to fulfill its legal obligations, including with government authorities for the purposes of verifying compliance with applicable laws.

Simple Credit may provide access to the client’s personal information to certain agents responsible for the operations and administration of the company’s affairs (sales and marketing, administration, operating system, legal affairs, etc.) or to third parties (technical services, postal services, servers, etc.) to the sole extent necessary for the execution of their mandate and in compliance with the obligations set out in the law.

Right of consultation and rectification

At all times, the client has the right to know the nature and origin of the information collected about them, to consult it and to request to make the necessary corrections or additions. Any request to this effect must be addressed to Simple Credit at the coordinates appearing at the bottom of this document.

 

Recommendations regarding creditworthiness

As part of the endorsement eligibility assessment, Simple Credit may obtain a recommendation regarding a client’s creditworthiness from a personal information officer. 

At any time, the client has the right to access these recommendations by contacting the Privacy Officer whose contact information appears at the bottom of this document.

Right to object and withdraw

At any time, the client may withdraw consent, in whole or in part, to the collection, use and disclosure of personal information. Such withdrawal may result in Simple Credit to provide some of its services and/or products. However, the consent given to the collection, use and disclosure of personal information for services in progress will remain valid until the client’s contractual obligations under the agreement are fully performed. Similarly, consent will remain valid in certain circumstances, including to retain transaction or business data, to disclose information to government authorities when required by law, etc. Any request relating to the withdrawal of consent to the collection, use or disclosure of personal information must be addressed to Simple Credit at the coordinates appearing at the bottom of this document.

 

Privacy incidents

In the event of a confidentiality incident involving personal information, Simple Credit will take all necessary and reasonable measures to reduce the risk of harm to the client, including, depending on the circumstances, notifying the Commission d’accès à l’information, notifying the client whose personal information is affected by the incident and notifying any person or organization likely to reduce the risk of harm to the client.

 

Privacy/Security

Simple Credit processes and stores the client’s personal information in a secure environment, for the duration of the contract with the client and for a reasonable period following the end of the contract in order to meet applicable legal, statutory, insurance, security and data processing requirements. The data are kept at the company’s place of business.

Simple Credit takes all reasonable steps to protect its clients’ personal information by using appropriate physical, electronic or security procedures, including safeguards to protect against loss or theft and secure areas (restrictions on disclosure, copying, use or modification).

The security systems applied by Simple Credit meet or exceed industry standards. The systems are tested regularly to update the security mechanisms in the context of constantly evolving technologies.

Destruction of personal information

When the purposes for which personal information was collected have been fulfilled, Simple Credit will destroy or anonymize the personal information in its possession.
